What is Bankruptcy?
As earlier pointed out, if you are struggling with student loan debt, you are far from being alone. College loans are a reality for most students, and it’s better to know what you’re getting into before you find yourself at the culmination of your college years. In its most basic definition, bankruptcy is a legal procedure used by individuals and corporations who cannot pay their debts. Whether you can file for bankruptcy on student loan debt, the answer is yes.
However, it is worthy to note that erasing the latter is not included in a bankruptcy standard filing. To discharge student loan debts, one must undertake additional procedures. Arguendo, that you comply with the necessary steps, there is still no guarantee that the bankruptcy court can erase all your debts.
Below are the additional steps and options you can take to eliminate your student loan debt.
If you have low income or the amount of your student loan debt is significantly higher than your income, you might be qualified for the following plans:
Income Contingent Repayment Plan (ICR) – If you have federal direct loans, you are ineligible for this type of plan because it calculates your payment in accordance with your income. Your monthly payment for this plan is the lesser of:
20% from your discretionary income; or
the repayment plan amount that you will pay with a stable payment for about 12 years, in accordance with your income.
If you are unable to pay your loan 25 years thereafter, you will get loan forgiveness from the government.
Income Sensitive Repayment Plan (ISR) – This plan is exclusive only to certain types of loan debts, such as, but not limited to, FFEL PLUS Loans, Federal Stafford Loans, either subsidized or unsubsidized, and among others. Your payments will be based on your family size, annual income, and overall loan amount.
Income-Based Repayment Plan (IBR) – If you are a new applicant on or around July 1, 2014, you must make payments amounting to 10% of your discretionary income, or around 15% of your discretionary income if you are not.
Pay As You Earn Repayment Plan (PAYE) – The monthly payment will be approximately 10% of your discretionary income. It will, however, not exceed the ten-year repayment plan standard amount. Under this plan, below are the eligible types of loans:
Direct Subsidized and Unsubsidized Loans;
Direct PLUS loans for the students; and
Direct Consolidation Loans that preclude PLUS loans for the parents.
Revised Pay As You Earn Repayment Plan (REPAYE) – There are other types of repayment plan such as graduated repayment plan, standard repayment plan, and the extended repayment plan.
